LEGAL

Terms for a governed environment.

The terms that govern access to and use of Daycostra.

Terms of Service

Effective date: 20 August 2026

These Terms of Service (“Terms”) govern your access to and use of Daycostra, including the Daycostra website, software development environment, AI-assisted generation features, runtime services, APIs, subscriptions, and related services (collectively, the “Service”).

Daycostra is operated by [LEGAL OPERATOR NAME], referred to in these Terms as “Daycostra,” “we,” “us,” or “our.”

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

If you do not agree, you must not use the Service.

1. The Daycostra Service

Daycostra is an AI-assisted software development platform designed to help users create, modify, execute, preview, and manage software projects using natural-language instructions and other development tools.

Depending on your plan and available features, the Service may include:

  • AI-assisted software and code generation
  • project workspaces
  • generated source files
  • isolated runtime environments
  • dependency installation and build execution

  • debugging and repair tools
  • project history and snapshots
  • third-party model integrations
  • usage analytics
  • APIs and integrations
  • subscription-based compute allowances

Features may change, improve, be added, or be removed over time.

2. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Service.

If you use Daycostra on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

You are responsible for ensuring that your use of Daycostra complies with applicable laws and regulations.

3. Account Registration

Some features require a Daycostra account.

You agree to provide accurate information and keep your account details current.

You are responsible for:

  • protecting your authentication credentials
  • activity performed through your account
  • securing connected third-party accounts
  • notifying us promptly if you believe your account has been compromised

You must not share access in a way that circumvents subscription limits, security restrictions, or account controls.

4. AI-Generated Software and Output

Daycostra may generate:

  • source code
  • configuration files
  • documentation
  • architecture suggestions
  • user interfaces
  • commands
  • application assets
  • patches
  • tests
  • other software-related output

AI-generated output may contain errors, vulnerabilities, omissions, incompatible dependencies, inaccurate assumptions, or unexpected behavior.

You are responsible for reviewing and validating generated output before relying on it in production, commercial, security-sensitive, financial, medical, safety-critical, or otherwise high-risk environments.

Daycostra does not guarantee that generated software will:

  • be error-free
  • be secure
  • meet every requirement in your prompt
  • be legally compliant
  • be free of third-party intellectual property concerns
  • remain compatible with future dependencies or platforms

The Service may automatically test, repair, build, or execute generated software, but automated validation does not replace appropriate human review.

5. Your Projects and Content

You retain ownership of content you submit to Daycostra, including prompts, project files, uploaded materials, and other content you provide (“User Content”).

You grant Daycostra a limited license to host, process, copy, transmit, transform, execute, and otherwise use User Content only as reasonably necessary to:

  • provide the Service
  • generate requested software
  • operate project workspaces
  • execute builds and runtime environments
  • provide previews
  • diagnose failures
  • maintain security
  • provide support
  • comply with applicable law

You represent that you have the necessary rights to provide User Content to the Service.

You must not upload or instruct Daycostra to use material in a way that unlawfully infringes the rights of others.

6. Generated Output and Ownership

Subject to applicable law and third-party rights, Daycostra does not claim ownership of software output generated specifically for you through your use of the Service.

You may generally use, modify, export, and commercialize generated output.

However, generated output may incorporate or depend upon:

  • open-source software
  • third-party libraries
  • package dependencies
  • APIs
  • model-provider outputs
  • third-party assets

Those components remain subject to their respective licenses and terms.

You are responsible for complying with applicable third-party licenses when distributing or commercializing your projects.

7. Runtime and Code Execution

Daycostra may execute generated or user-provided software in isolated runtime environments.

You must not intentionally use Daycostra runtime infrastructure to:

  • compromise systems
  • distribute malware
  • mine cryptocurrency without authorization
  • operate botnets
  • perform denial-of-service attacks
  • scan or exploit third-party systems without authorization
  • steal credentials or data
  • bypass access controls
  • run prohibited automation
  • conceal unlawful activity
  • abuse third-party infrastructure

Runtime environments may be automatically:

  • created
  • suspended
  • restarted
  • rate-limited
  • terminated
  • deleted

to protect the Service, enforce plan limits, manage resources, or address security concerns.

We may stop execution that threatens platform stability, other users, third parties, or our infrastructure.

8. Acceptable Use

You may not use Daycostra to:

  • violate applicable law
  • infringe intellectual property rights
  • distribute malware or malicious code
  • gain unauthorized access to systems or accounts
  • facilitate fraud or deceptive activity
  • abuse payment systems
  • interfere with Daycostra infrastructure
  • evade usage or subscription limits
  • impersonate another person or organization
  • extract or expose confidential data without authorization
  • resell access in a manner that bypasses applicable commercial terms

We may suspend or terminate access where we reasonably believe these Terms have been violated.

9. Third-Party AI Providers

Daycostra may use third-party artificial intelligence providers and models to process instructions and generate output.

Depending on configuration and availability, different models may be selected based on:

  • capability
  • latency
  • cost
  • context requirements
  • availability
  • user selection
  • runtime policy

Third-party providers may process relevant portions of your prompts or project context as necessary to provide requested AI functionality.

Their services are governed by their own infrastructure, availability, and policies.

We do not guarantee uninterrupted availability of any particular model or provider.

10. Third-Party Services and Integrations

Daycostra may integrate with external services such as:

  • payment providers
  • authentication providers
  • source-control platforms
  • hosting providers
  • sandbox/runtime providers
  • analytics services
  • AI providers
  • storage providers

Use of those services may also be subject to their respective terms and privacy policies.

Daycostra is not responsible for independent third-party services outside our reasonable control.

11. Subscriptions

Certain functionality requires a paid subscription.

Daycostra may offer subscription plans including:

  • Launch
  • Builder
  • Studio

Plan features, compute allowances, storage, runtime capacity, model access, and other limits may vary.

Current pricing and included features are displayed on the pricing or checkout page.

Subscriptions renew automatically at the applicable billing interval unless cancelled before renewal.

12. Payments

Where paid subscriptions are available, payment processing is provided through Stripe.

Daycostra does not directly store complete payment-card details.

Stripe may collect and process payment and billing information under Stripe's own terms and privacy policy.

You authorize the applicable subscription charges when completing checkout.

Taxes may be added where required.

13. Cancellation

You may cancel a subscription through the available billing or customer-management interface.

Unless otherwise stated at checkout:

  • cancellation stops future renewal
  • access to paid features generally continues until the end of the current paid billing period
  • unused compute, credits, or subscription capacity does not automatically carry forward

Deleting your Daycostra account is separate from cancelling a subscription.

14. Refunds

Except where required by applicable law or expressly stated otherwise, subscription payments are generally non-refundable after the applicable service period has begun.

If you believe a payment was made in error, contact:

Consumer rights that cannot legally be waived remain unaffected.

15. Compute and Usage Limits

Daycostra may measure consumption of platform resources, including:

  • AI model usage
  • tokens
  • runtime duration
  • sandbox resources
  • storage
  • bandwidth
  • generated artifacts
  • repair attempts
  • concurrent runtimes

Plans may include limits or compute allowances.

If you reach a limit, Daycostra may:

  • pause new generations
  • prevent additional runtime allocation
  • reduce available functionality
  • request an upgrade
  • offer additional compute
  • wait until usage resets

We may enforce reasonable safeguards against excessive, automated, abusive, or unintended consumption.

16. Service Availability

We aim to provide a reliable Service but do not guarantee uninterrupted operation.

The Service may occasionally be unavailable because of:

  • maintenance
  • software updates
  • third-party outages
  • model-provider outages
  • infrastructure failures
  • security incidents
  • network conditions
  • circumstances outside our reasonable control

Features dependent on external providers may become temporarily unavailable without notice.

17. Beta and Experimental Features

Some Daycostra features may be marked beta, preview, experimental, or otherwise under development.

Such features may:

  • change significantly
  • produce unexpected results
  • have reduced reliability
  • be removed
  • have additional restrictions

Use experimental functionality accordingly.

18. Security

Daycostra uses technical and organizational safeguards intended to protect the Service and user data.

However, no online service can guarantee absolute security.

You are responsible for protecting:

  • credentials
  • project secrets
  • API keys
  • generated applications
  • production deployments
  • data stored in your own applications

Do not place secrets directly into prompts or source code when secure secret-management mechanisms are available.

19. Intellectual Property

Daycostra and its underlying platform, including its proprietary software, interfaces, branding, design systems, documentation, and infrastructure, are owned by Daycostra or its licensors.

These Terms do not grant you ownership of the Daycostra platform itself.

You may not copy, reverse engineer, redistribute, or commercially exploit proprietary portions of the Service except where expressly permitted by law or written agreement.

20. Feedback

If you provide feedback, suggestions, ideas, or feature requests, you permit Daycostra to use that feedback without restriction or compensation.

This does not transfer ownership of your project content.

21. Suspension and Termination

We may suspend or terminate access where reasonably necessary because of:

  • material violation of these Terms
  • security threats
  • fraudulent activity
  • payment failure
  • unlawful use
  • abuse of runtime infrastructure
  • attempts to circumvent platform restrictions

Where reasonable, we may provide notice or an opportunity to resolve the issue.

You may stop using Daycostra at any time.

22. Data After Termination

Following account termination or deletion, project data may be deleted after an appropriate retention period, subject to:

  • backup retention
  • fraud prevention
  • billing records
  • security logs
  • legal requirements

Export important projects before closing your account.

23. Disclaimer of Warranties

To the extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Daycostra does not warrant that:

  • generated code will be flawless
  • output will meet every intended purpose
  • the Service will always be available
  • every vulnerability will be detected
  • generated output will be unique
  • third-party services will remain available

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Daycostra will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Service.

This may include loss of:

  • profits
  • revenue
  • data
  • business opportunities
  • goodwill
  • production availability

Nothing in these Terms limits liability where applicable law does not permit such limitation.

25. Indemnification

Where legally applicable, you agree to be responsible for claims resulting from:

  • your unlawful use of the Service
  • your User Content
  • software you deploy or distribute
  • infringement caused by materials you supplied
  • your violation of these Terms

This provision applies only to the extent permitted by applicable law.

26. Changes to the Service

Daycostra will continue to evolve.

We may modify:

  • functionality
  • models
  • integrations
  • subscription offerings
  • resource limits
  • APIs
  • technical architecture

Material changes affecting paid subscriptions will be communicated where reasonably required.

27. Changes to These Terms

We may update these Terms from time to time.

The updated version will show a revised effective date.

Where legally required, we will provide additional notice of material changes.

Continued use after updated Terms become effective constitutes acceptance where permitted by law.

28. Governing Law

These Terms are governed by the laws applicable to the operator of Daycostra and mandatory consumer protections applicable to the user.

Before publishing this section, Daycostra will specify its legal operator and governing jurisdiction.

Nothing in these Terms removes mandatory rights available to consumers under applicable law.
